Empowering Grassroots Organizations: Understanding Federal Prosecutions
As a follow-up to MJF’s Community Guide for Grassroots Groups, an essential resource designed to support grassroots organizations, fiscally sponsored projects, and fiscal sponsors working in mutual aid, bail funds, and Palestine solidarity initiatives, we are launching a follow-up community resource focused on understanding federal prosecutions. This guide provides critical Know Your Rights (KYR) information about the difference between state and federal prosecutions, and ways community members can equip themselves with knowledge. Federal criminal prosecutions have historically been heavier, more punitive, and more difficult to fight. They are used to suppress and destroy social movements. Under the Trump administration, we expect federal prosecutions to get worse, and want our communities to get ready and stay ready! The document outlines key differences in areas like defense attorney power, double jeopardy, sentencing, bond/bail, and types of crimes prosecuted at the federal level. It emphasizes the broad reach of federal jurisdiction and the potential for targeting political activists. The document also provides security culture advice, including carrying valid ID, having emergency plans, and being cautious with technology and finances. It advises individuals to build trusted relationships and to consult with lawyers if necessary. Overall, the document aims to equip community members and movement organizers with knowledge and strategies to navigate the complexities of the legal system and protect themselves from state repression.
